5. Licenses for Activities in Information Technology

General Provisions

Pursuant to Law No. 451-XV of 30.07.2001 on Regulating Entrepreneurial Activity through Licensing, with the modifications introduced by Law No. 176 of 15.07.2010, on November 10, 2010, ANRCETI started to issues licenses for activities in the field of information technology: for services of creating, implementing and ensuring the operation of automated information systems of state interest, including software.

Who can apply for a license?

Legal entities, registered in Moldova, regardless of property type and legal form of organization, as well as natural persons, having the right to practice certain types of activities subject to licensing.

What documents are required to obtain a license?

To obtain the licence, the applicant must fill in and file to ANRCETI a declaration/application according to the pre-established Form (in state language), available at ANRCETI office or downloadable on the Agency web page.
The following documents (copies) shall be attached to the declaration/application:
 - Identity document of the decision-making person.

How is the application submitted to the Agency?

The application can be submitted to the Agency in one of the following ways:
- submitting it personally or having it submitted by a representative of the applicant, under signature;
- sending it via registered mail service with advice of delivery.

How long does it take the Agency to adopt a decision?

ANRCETI Administrative Board adopts the decision to issue the license within 10 days after the appropriate application has been filed in. The license is prepared and delivered to the applicant within 3 working days from the date the document confirming payment of license fee was received. The amount of this fee, established by law, is 3250 lei, which is fully transferred to the state budget.

With the license, the applicant receives the license terms that have been approved by the Administrative Board Decision No. 33 of 04.11.2010.

Where the applicant fails to provide a document confirming the payment of the prescribed fee, within 30 days from the date he has been notified on the license issuance decisión, for unjustified reasons, ANRCETI has the right to cancel its decision.

What is the license validity term?

The license validity term is 5 years and can be extended, for as long, under the legislation in force.
