Provider’s Guide

1. Notification (General Authorization)

Persons intending to provide electronic communications networks and/or services are required to undergo the authorization procedure, set forth in the Law on Electronic Communications no.241-XVI and the Regulations (doc. in state language) on General Authorisation Regime and License Issuance for the Use of Limited Resources in the Provision of Electronic Communications Networks and Services, approved by ANRCETI Administrative Board Decision no. 57 of 21.12.2010. The mentioned documents also prescribe the conditions set for the provision of electronic communications networks and/or services.

1. The following types of public electronic communications networks shall be subject to general authorisation regime:
1) Terrestrial networks with access at fixed location;
2) Terrestrial networks for electronic communications distribution (last mile);
3) Terrestrial networks for electronic communications transportation (backbone);
4) Terrestrial cell mobile radion networks;
5) Terrestrial broadcasting networks;
6) Satelite Access networks.

2. The following types of public electronic communications services shall be subject to general authorisation regime:
1) Telephony services;
2) Call transportation services;
3) Leased line services;
4) Data transmission services;
5) Internet Access Services;
6) Audiovisual program services.

Detailed description of electronic communications networks and services is available in the Classified List of Types of Networks and Services subject to general authorisation regime (Annex no.1 to the Regulations - doc. in state language).

Who can submit a notification?

A notification (general authorization) can be filed to the Agency by both legal persons, registered in the Republic of Moldova, regardless of the type of property and legal organizational form and natural persons, intending to provide electronic communications networks and/or services.

How does a notification take place?

The applicant has to fill in the Standard Notification Form (Annex no.2 to the Regulations) and the Form of Public Electronic Communications Network/Service Description (Annex no.3 to the Regulations) and provide a copy of the identity document of a person in charge, which is an integral part of the notification.

Remark: The notification is considered successfully performed if all the legal requirements in terms of submission form and contents have been accomplished.

How are the Standard Form and associated documents filed to the Agency?

The documents can be filed to the Agency in either of the two ways:
1) by submitting personally or having them submitted by the applicant’s or provider’s representative in charge, under signature;
2) by means of registered mail with advice of delivery.

How long does it take for the Agency to adopt a decision?

The Agency, within 7 days from submission of notification, issues an informative Declaration (Annex no.4 to the Regulations - in state language), confirming the submission of the notification by the applicant, his being entered in the Public Register of Electronic Communications Networks and Service Providers and issuance of general authorization conditions.

Remark: All the procedures comprised in the general authorization regime, including the entry in the Public Register of Electronic Communications Networks and Service Providers, are free of charge.

What are the legal effects of the notification?

The person that has performed the notification is authorized to provide the types of electronic communications networks and/or services indicated in the notification, having the rights and obligations provided by law and set forth in the general authorization conditions.

Remark: Obtaining the right to provide a certain type of electronic communications services indicated in the notification does not imply the right to provide another type of electronic communications services or the right to provide electronic communications networks.

What is the notification validity term?

The general authorization is not time-restricted.
