National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

According to the provisions of the Law on Electronic Communications no. 241-XVI of 15.11.2007, where as a result of market analysis, conducted under the law, a provider has been designated as having significant market power, ANRCETI imposes one or more of the following obligations:
a) to ensure transparency in relation to interconnection or access to electronic communications networks and associated facilities;
b) to publish the reference offer;
c) to admit no discrimination in relation to interconnection or access;
d) to keep separate accounting;
e) to supply accounting records;
f) to ensure access and use of the specific elements of the networks and associated facilities;
g) to recover investments, keep control over tariffs and make them cost-oriented;
h) to supply all information, serving as basis for establishing and adjusting tariffs.

Where, as a result of a market analysis conducted under the law, the Agency determines that a relevant market is efficiently competitive, it shall accordingly withdraw or amend the imposed obligations. In conducting market analysis, the Agency, where necessary, shall request collaboration with the competition protection authority.

The Agency, at least 30 days before withdrawing any obligations imposed on a provider, shall notify the intention to the persons-parties to interconnection and access agreements with the given provider, in order to allow them to find alternative providers or renegotiate the agreements already signed.
