Printer-friendly versionPursuant to the Law on Electronic Communications no. 241-XVI of 15.11.2007, a provider shall be considered to have significant market power on a relevant market, if he holds 35% or more market share, as a result of market analysis, and if the Agency finds that particular market is not effectively competitive.
The Agency publishes and presents to the competition authority the decision regarding designation of providers with significant market power on relevant markets within 3 days from the date it was adopted. The competition authority, within 10 days, must enlist the providers with significant market power on relevant electronic communications markets in the List of Economic Entities with Dominant Position on Relevant Electronic Communications Markets and publish the List in the Official Gazette of the Republic of Moldova. Upon the expiry of the term for inclusion in the given List, the Agency shall have the right to adopt decisions on imposing special obligations on providers designated as having significant market power on the relevant market.
It is also ANRCETI’s obligation to make publicly available the aforementioned List.
