Economic Regulation

The economic regulation of the electronic communications network and service market is one of the main functions of the regulator, as provided by the Law on Electronic Communications no. 241-XVI of 15.11.2007. This activity is targeted at competition promotion and protection of users’ legal rights and interests under transparent, impartial and objective conditions.
It is the mission of the Economic Regulation and Analysis Department of the Agency to exercise these functions, by fulfilling the following basic tasks:
- Identification of relevant markets and development of regulations for market analysis;
- Designation of electronic communications network and service providers with significant market power on relevant markets;
- Selection of market remedies (preventive obligations) and assigning obligations to providers with significant market power on relevant markets;
- Development of regulations and methodological norms with reference to:
     - Calculation of wholesale costs of electronic communications services;
     - Calculation of rates for retail communications services, provided by providers with significant market power on those markets;
     - Separate accounting per activities by providers with significant market power on relevant markets that were assigned with such a binding obligation;
     - Calculation of Universal Service net cost.
- Regulation of tariffs for retail electronic communications services (intended for end-users), provided by providers with significant market power on relevant markets, in accordance  with  the approved methodologies;
- Safeguarding competition on retail service markets by preventing price squeeze by providers with significant market power on relevant retail markets;
- Development of annual and quarterly statistical reports on evolution of electronic communications network and service market.
