National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) has placed on its web page, for public consultations, two draft Administrative Board Decisions on designating JSC “Moldtelecom” as SMP provider on two relevant markets: market for call origination at fixed locations dof the public telephone network and the market for traffic transit in the public telephone network. The consultations will last through June 13, 2011, this being the deadline for recommendations.

The draft documents were developed under Article 9 (1) a) and m) of the Law on Electronic Communications, the Regulations on the identification and analysis of relevant markets and the designation of electronic communications networks and/or service providers with significant market power, Administrative Board Decisions No. 24, No. 25 of 19.08.2010 on identification of the market for call origination at fixed locations of the public telephone network and identification of the market for traffic transit in the public telephone network.

The draft documents are based on detailed analysis of the market for call origination at fixed locations of the public telephone network and the market for traffic transit in the public telephone network, conducted by ANRCETI specialists with the support of the consultants of EBRD technical assistance project, currently delivered to the Agency.

The analysis showed that JSC “Moldtelecom” has significant power on both markets: for call origination at fixed locations of the public telephone network and for traffic transit in the public telephone network. Based on the analysis, the Agency determined the SMP of the JSC “Moldtelecom” on these markets.

The Explanatory Note 1 and 2 supplementing the documents, the Agency is planning to propose for public consultation the draft Board Decision imposing special ex-ante obligations on JSC “Moldtelecom”, in order to remedy the existing competition problems on those markets.
