Monitoring and Control

The activity of surveillance and control is one of the basic functions of the Agency, as provided by the Law on Electronic Communications no. 241-XVI of 15.11.2007. It is targeted at promoting competition and protecting the rights and interests of users, under transparent impartial and objective conditions and is referred to legal and natural persons, falling under the scope of the legislation pertaining to electronic communications and information technology.

The surveillance and control is one of the duties carried out by the Authorisation and Control Department of the Agency (DAC) of ANRCETI, in compliance with the Regulations on Control Procedure in electronic communications, approved by ANRCETI Administrative Board Decision no. 9 of 18.08.2008 and published in the „Official Monitor of the Republic of Moldova” on 12.09.2008.

The Regulations sets forth the control procedure, types and subjects. Control actions are focused on checking quality of electronic communications services, compliance with general authorisation conditions and ANRCETI regulations governing users’ rights protection, transparency of tariffs and conditions of use of public electronic communications services.

According to the Regulations, ANRCETI is entitled to exercise control of network and service providers, selected according to the criterion of a presumed prejudice which might be caused as a result of non-compliance with the legislation in force, but once a year at most on a specific subject. The number of unplanned controls, regardless of their purpose, cannot exceed 50% of the planned control number. ANRCETI must notify the provider in advance about any control action: for a planned one – at least three days in advance, for an unplanned one - on the very day.

ANRCETI does not limit control to only detecting violations and applying sanctions, but focuses on preventing deviations from the legislation committed by electronic communications network and service providers.
