National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) published on its website, for public consultation, draft (.pdf) Administrative Board Decision on approving the mechanism for financing and compensation of the net cost of providing services within the scope of universal postal service. According to the Law on Postal Communicatons (hereinafter - Law no. 36/2016), this draft document will be examined and approved by the Government. The public consultation will last through July 13, which is the deadline for submitting recommendations on this document.

According to the Explanatory Note, the draft decision was developed under Law no. 36/2016 and is aimed at mitigating the impact of potential financial losses incurred by State Company "Posta Moldovei", as the universal postal service provider designated by Law no. 36/2016, as a result of providing postal services within the scope of the universal postal service, the financing of which is accomplished by granting the exclusive rights for the provision of reserved postal services.

The draft document developed by ANRCETI establishes the method of net cost calculation and the procedure of compensation for the provision of postal services within the scope of universal postal service.

According to the project, State Company "Posta Moldovei" shall calculate the net costs of providing postal services within the scope of the universal postal service as the difference between the sum of operational revenues from every service within the scope of the universal postal service and the sum of operational costs and of capital per every such service. In the calculations, the company "Posta Moldovei" will use the data on costs, obtained according to the Methodology of cost allocation per reserved and non-reserved services, developed and approved by ANRCETI, according to Art. 31 (3), of Law no.36/2016.

As well, "Posta Moldovei" will produce an Annual Report on the net cost of providing postal services within the scope of the universal postal service, with due conclusions and will submit it to ANRCETI by May 31 of the year following the reporting financial year. After analyzing the Report, ANRCETI will decide on the opportunity to also reserve for “Posta Moldovei” the exclusive right to supply advertising mail within price and weight limits laid down in Article 28, (1) and (3) of Law no. 36/2016.
