Most Common Contraventions In Electronic Communications In First Half Of 2015

According to a report by the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), the nature and number of contraventions recorded by ANRCETI, acting as acknowledging Agent, following the inspections performed in the first half of the year, significantly changed compared to same period of 2014. The number of contravention reports concluded by ANRCETI reduced more than 1,5 times: from 27 to 16, in most cases referring to businesses.

Of the 16 contravention reports, six referred to natural persons, the rest – to legal entities. All the reports were submitted for examination to court in Chisinau.

Most contravention cases were started on persons responsible for placing non-compliant and uncertified electronic communication equipment, for producing harmful interference in mobile networks; violation of protection marks for electronic communications lines and facilities; unauthorized connection or admission of unauthorized connection to electronic communications networks. 12 reports were drawn up for these illegal acts. However, the number of reports for producing harmful interference in mobile networks reduced more than four times: from 13 in the first half of 2014 to 3 in the same period of 2015.

During the reporting period, the court examined and pronounced judgments on 16 reports on contravention, concluded by ANRCETI. In nine cases the court applied fine totaling 1 650 conventional units or 33 thousand lei. The highest fines were imposed for the placing non-compliant and uncertified electronic communication equipment on the electronic communication market and for unauthorized provision of electronic communications networks or services. For such contraventions, companies BM TECHNOTRADE, AV-ELECTRONIC, AV-MACROCOM and INTERBIT-NET were fined 200 conventional units or 4 thousand lei each.

In five cases the court admitted the guilt of the offenders, but did not apply any penalties due to expired statute of limitations (3 months), while two cases were dismissed for lack of proof against contravener.

Pursuant to the legislation, ANRCETI is entitled to supervise observance and application of normative documents in electronic communications, to acknowledge contraventions in electronic communications, postal and information technology field by concluding reports and submitting them to court. The fines imposed on offenders by the court are fully paid into the state budget.
