Public Session to Approve Draft Standard Contract on Access of Public Electronic Communications Providers to Public or Private Property

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces, a public meeting scheduled for Thursday, July 7, 14.00, to review and submit for approval the draft (.pdf) Administrative Board Decision approving the standard Contract for access on public or private property for the construction (installation), maintenance, removal, replacement, transfer or retrofitting of public electronic communications networks or associated infrastructure elements. The meeting will take place at ANRCETI (134, Stefan cel Mare bd., 5th floor. Conference Room).

The draft Decision was subject to the public consultation procedure by means of ANRCETI official website in the timeframe May 25 - June 14, 2016. ANRCETI received feedback from five providers – "Orange Moldova", "Moldcell" "StarNet Servicii", "Arax-Impex", "Sun Communications" and the Ministry of Information Technology and Communications. The recommendations were discussed at public debates organized on July 1, 2016. ANRCETI’s opinion regarding the recommendations is available in the Summary of Recommendations, published on ANRCETI official website.

The draft standard Contract was developed under the Law on access to the properties and shared use of infrastructure associated to public electronic communications networks, no. 28 of 10/03/2016, hereinafter - Law No.28/2016, which requires the use of a standard contract, which establishes the conditions for the right of access of a public electronic communications network provider, authorized under the Law on Electronic Communications, to the private property of the state, administrative-territorial units and natural or legal persons, or on public property of the state or territorial administrative units.

The Explanatory Note to the standard Contract, developed by ANRCETI, states that it is of recommendatory nature and aims mainly at structuring and informing about the rights and obligations of providers as regards access to public and private property. The contract reflects the provisions of Law No.28/2016 and includes, among others, provisions relating to the rights and obligations of the parties to the contract, the duration of the contract and the arrangements for its termination, tariffs and methods of payment, etc.

According to Law No.28/2016, the standard contract of access to public or private property for the construction (installation), maintenance, removal, replacement, transfer or retrofitting of public electronic communications networks or associated infrastructure elements will be published by ANRCETI on its official website within three months from the date this law entered in force (July 15th, 2016).
